Construction and investment process
Since the establishment of the Law Firm, the provision of legal support to Clients in the investment and construction process has been one of the main areas of our advice. Owing to the experience of many years in representing interests of various participants of the investment process as well as the knowledge of mechanisms of administrative bureaucracy, we are able to translate administrative jargon into business language and offer practical solutions to even most unusual situations.
We were involved in a number of successfully completed investment projects of our Clients, including infrastructure and developer projects implemented in various regions of the country.
Areas of practice
We carry out a comprehensive legal due diligence of investment areas, both at the pre-execution stage and after the project completion.
We act as representatives of investors or other parties in proceedings conducted before public administration authorities (e.g. in proceedings for the issuance of environmental permits, decisions on building and land development conditions, building permits).
We assist investors in developing or selecting the most proper model of investment financing (project finance, PPP, so-called alternative financing methods), support them in negotiations with entities financing projects and in drafting any documentation required by such entities.
Our team supports investors or local governments in drafting and negotiating contracts setting out the scope of infrastructure investments accompanying the main project (e.g. regarding the construction or reconstruction of public roads or water supply and sewage systems).
We assist our Clients in the implementation of greenfield and brownfield projects, help them in obtaining any necessary permits and having the study of conditions and local plan modified or adopted.
Our lawyers assist in drafting and negotiating contracts entered into during the investment and construction process (e.g. contracts for design services, construction works, general constructing, subcontracting, project management or contracts based on the FIDIC standard).
We represent Clients in litigation before civil courts (e.g. concerning claims for payment for any works completed and disputes over compensation for the improper performance of the contract) and administrative courts (e.g. concerning appeals against administrative decisions or legal acts issued or adopted by bodies of local government units, such as studies of conditions, local land development plans).
