Wojciech Andrzejewski

Attorney at law, Partner, Head of the Energy and Real Estate Team. Graduate of the Adam Mickiewicz University in Poznań, Faculty of Law and Administration. Member of the Regional Bar Association in Poznań. He has been with Piszcz and Partners Law Firm since 2006.

At the Law Firm, he leads a team specialising in providing expert advice on various aspects of energy law and legal regulations regarding the investment process. He supports Clients in the negotiations of key purchase contracts (electricity and gas, including those based on the EFET format), in regulatory risk management (compliance) and in drafting legislative proposals for regulations regarding the energy sector.

Mr Andrzejewski represents Clients in proceedings before the President of the Energy Regulatory Office (URE) and before courts (including in matters regarding concessions, tariffs, exemptions from the TPA rule and fines). He advises energy companies and energy-intensive consumers on their day-to-day business in the area regulated by energy law.

He also has extensive knowledge of and expertise in the field of administrative regulations regarding the investment process, municipal services management and implementation of tasks by state and local government bodies. He has negotiated investment agreements with local government authorities, conducted training on issues related to the investment process, and advised on functional and spatial transformation processes and commercialization of prestigious properties.
He has represented Clients in administrative proceedings, disputes before administrative courts and proceedings before the Supreme Audit Office.

  • advising on restructuring and consolidation processes to companies being members of the biggest energy groups in Poland and on the process of acquisition of RES projects (biogas plants and wind farms) with the total capacity of several hundred MW;
  • responsible for the drafting of Instructions of the Transmission System Operation and Maintenance /IRiESD/ for several gas and electricity providers, compliance programs and model electricity/gas connection, distribution, sales agreements, comprehensive agreements for companies of the largest energy groups, for vertically integrated entities and the so-called alternative sellers;
  • advising to companies of two energy groups on the development of so-called Compliance programmes as well as internal mechanisms and procedures to ensure full independence of operations of the DSO within a capital group;
  • supporting one of the entities in the energy-intensive sector in legislative works on the Energy Efficiency Act;
  • negotiating on behalf of a heat power company a long-term agreement for the purchase of heat, securing the supply of heat to several thousand consumers;
  • representing PKP S.A. (Polish National Railways) in several dozen expropriation proceedings and municipalisation disputes with local government units in the whole country, also in the process of regulating the legal status of the so-called Wolne Tory area in Poznań (approx. 30 ha in the city centre);
  • negotiating on behalf of one of the investors with the City of Poznań on the terms of a participation agreement regarding the conversion of the traffic system in connection with the construction of a new railway station;
  • advising to a company in the water supply and sewage sector on the process of regulating the legal status of the land occupied by transmission infrastructure;
  • advising on the process of changing the study of conditions for Poznań in connection with the planned transformation of the previously industrial area in the centre of Poznań (approx. 10 ha) into residential area;
  • representing the Marshal Office of the Wielkopolskie Province in negotiations with rail service provides on the conclusion of public service contracts (PSC).
