1. Privacy Policy of Kancelaria Prawna Piszcz i Wspólnicy sp. k. in Poznań

In this Privacy Policy, Kancelaria Prawna Piszcz i Wspólnicy sp. k. with the registered office in Poznań (hereinafter the “Law Firm”) presents the most important issues concerning the processing of personal data collected via the website and other sites, including their protection and security. Acting as Controller of your personal data, we shall ensure adequate protection of the information and personal data regarding Users visiting our website at https://piszcz.pl/pl/ and using any sites operated by the Law Firm.

I. Definitions

1. Controller/Law Firm – means Kancelaria Prawna Piszcz i Wspólnicy sp. k. with the registered office in Poznań at ul. Towarowa 35, entered in the register of entrepreneurs of the National Court Register (KRS) under number 0000084891, NIP: 7822109761, REGON: 631284687, who acting as administrator of the portal on the website: https://piszcz.pl/pl/, processes personal data of Users.

2. Website – a website operated at https://piszcz.pl/pl/, administered by Kancelaria Prawna Piszcz i Wspólnicy sp. k. with the registered office in Poznań.

3. Site – means any website or application through which the Controller runs an online site on the domain https://piszcz.pl/pl/.

4. Law at Work (Prawo w Pracy) Site – means a website or an application through which the Controller runs an online site – labour law blog titled “Law at Work” (Prawo w Pracy) on the domain https://www.prawowpracy.pl/.

5. Legal Viewfinder (Wizjer Prawny) Site – means a website or an application through which the Controller runs an online site with legal advice on real estate, titled “Legal Viewfinder” (Wizjer Prawny) on the domain https://www.wizjerprawny.pl/.

6. Legal Radar (Radar Prawny) Site – means a website or an application through which the Data Controller runs a site – “Legal Radar” (Radar Prawny) bulletin addressed to managerial staff of small, medium-sized and large enterprises, on the domain https://biuletyn.piszcz.pl/.

7. Device – means an electronic device through which the User accesses the Controller’s Website, Site, Law at Work Site, Legal Viewfinder Site or Legal Radar Site, e.g. mobile devices, computers.

8. User – means an entity using the Controller’s Website, Site, Law at Work Site, Legal Viewfinder Site or Legal Radar Site, whose personal data are processed by the Law Firm.

II. What is GDPR?

The GDPR, i.e. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, is an EU regulation governing the issue of personal data protection and their security.

The GDPR has come into force on 25 May 2018 across all the EU member states. The GDPR provisions relate, for example, to the processing of personal data via the Internet, including via the Controller’s Website, Site, Law at Work Site, Legal Viewfinder Site or Legal Radar Site, administered by Kancelaria Prawna Piszcz i Wspólnicy sp.k.

III. What is personal data?

Pursuant to the GDPR, personal data means any information relating to an identified or identifiable natural person. Such data include, for example, the following information: a forename and a surname, an email address or a telephone number, collected via the Controller’s Website, Site, Law at Work Site, Legal Viewfinder Site or Legal Radar Site.

V. Legal basis for the processing of personal data

Personal data processed by the Controller via the Controller’s Website, Site, Law at Work Site, Legal Viewfinder Site or Legal Radar Site, are processed pursuant to the provision of Article 6(1)(a) of the GDPR, i.e. based on the consent given by the User.

The processing of personal data of the Law Firm’s clients for the performance of marketing activities by the Law Firm constitutes the Controller’s legitimate interest (Article 6(1)(f) of the GDPR).

The provision of personal data by Users is voluntary but required to achieve the purposes for which they are collected and processed by the Law Firm.

VI. Purposes of the processing of personal data collected via the Controller’s Website, Site, Law at Work Site, Legal Viewfinder Site or Legal Radar Site

1. Site – personal data are collected by the Controller in order to ensure the proper use of the Site. Personal data collected via the contact form available on the Website are collected by the Controller to reply the User’s query, contact the User or send a commercial offer and carry out marketing activities. Personal data collected via the Website, under the Career tab, are collected for the purpose of carrying out recruitment processes by the Law Firm. Personal data collected via “Newsletter” are collected for the purpose of receiving the newsletter by the User who has subscribed to it.

2. Law at Work (Prawo w Pracy) Site – personal data are collected by the Controller in order to ensure the proper use of the Law at Work Site. Personal data collected via “Newsletter” are collected for the purpose of receiving the newsletter by the User who has subscribed to it.

3. Legal Viewfinder (Wizjer Prawny) Site – personal data are collected by the Controller in order to ensure the proper use of the Legal Viewfinder Site. Personal data collected via “Newsletter” are collected for the purpose of receiving the newsletter by the User who has subscribed to it.

4. Legal Radar (Radar Prawny) Site – personal data are collected by the Controller in order to ensure the proper use of the Legal Radar Site. Personal data collected via “Newsletter” are collected for the purpose of receiving the newsletter by the User who has subscribed to it.

VII. Period of processing of Users’ personal data

Users’ personal data collected in connection with the achievement of the purposes defined in Section VI(1) hereof, i.e. within the scope of data obtained via the contact form available on the Website, shall be processed by the Controller for the period of 2 years, unless the User withdraws the consent during that period.

Users’ personal data collected in connection with the achievement of the purposes defined in Section VI(1-4) hereof, i.e. receiving a newsletter via the Site, Law at Work Site, Legal Viewfinder Site or Legal Radar Site, shall be processed by the Controller until the User unsubscribes from the newsletter but no longer than for the period of 2 years (i.e. for the subscription period). As part of performance of the tasks related to the protection of personal data, the Controller shall have the right to send, prior to the expiry of the period referred to in the preceding sentence, a text message or an email to the User, informing about the planned end of the subscription period. If no further consent to the processing of personal data is given by the User for the purpose of receiving a newsletter via the Site, Law at Work Site, Legal Viewfinder Site or Legal Radar Site, the User’s personal data shall be erased due to the end of the subscription period.

Personal data of Users being job applicants, collected for the purpose of the recruitment process, shall be processed for the period of 6 months from the end of the process of recruiting for the position the User applied for.

If the User withdraws consent to the processing of personal data by the Law Firm for the purposes specified in Section VI(1-4) hereof, the data shall not be processed by the Law Firm, unless there is another legal basis for their processing.

VIII. Who are your personal data transferred to?

Recipients of your personal data shall include: employees and associates of the Controller, entities operating communication and information systems and providing information tools, service entities, entities operating and maintaining IT network, entities cooperating with the Controller in providing marketing services, as well as entities providing advisory, legal, consulting and audit services.

The data of Users shall not be transferred to any third countries.

IX. What are the rights of Users under the GDPR?

Users shall have the right to obtain from the Controller:

1. access to any personal data provided by Users concerning individual Users, subject to the provisions of Article 15(3) of the GDPR (Article 15 of the GDPR);

2. the rectification of the data (Article 16 of the GDPR);

3. the erasure of any personal data provided by Users, i.e. the “right to be forgotten” (Article 17 of the GDPR);

4. the restriction of processing of the User’s personal data (Article 18 of the GDPR);

5. the portability of the User’s personal data (Article 20 of the GDPR);

6. withdrawal of the consent given to the processing of personal data at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

Furthermore, pursuant to Article 21 of the GDPR, where personal data are processed based on the legitimate interests pursued by the Controller, i.e. under Article 6(1)(f) of the GDPR, Users shall have the right to object. As a result, the Controller shall not be able to process any personal data of Users subject to objection on that ground, unless the Controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.

The aforementioned rights may be exercised by Users as follows:

1. by contacting the Personal Data Protection Officer appointed by the Controller, either by phone at +48 (61) 859 44 44 or by email at iod@piszcz.pl,

2. by sending a written request to the address of the Controller’s registered office: Kancelaria Prawna Piszcz i Wspólnicy sp. k. ul. Towarowa 35, 61-896 Poznań.

X. Complaint to a supervisory authority

Users have the right to lodge a complaint with a supervisory authority, i.e. the President of the Office for Personal Data, if they consider that the processing of personal data by the Controller infringes the applicable provisions of law.

XI. Automated decision-making, including profiling

Users’ personal data processed by the Law Firm for the purposes specified in Section VI(1-4) hereof shall be processed by automated means (via the Controller’s Website, Site, Law at Work Site, Legal Viewfinder Site or Legal Radar Site); however, the Controller shall not make decisions in respect of the data by automated means and the data shall not be subject to profiling.

XII. Modifications to the Privacy Policy

The Controller shall revise this Privacy Policy on a regular basis and to modify it whenever it proves necessary or desirable due to the entry into force of new provisions of law or guidelines of the authorities. Moreover, the Law Firm reserves the right to change this Privacy Policy if the means, purposes or legal bases of the Users’ personal data processing have been changed.
