New Water Law – optimisation of water costs

A new act, the Water Law, have come into force on 1 January 2018 (Journal of Laws of 2017, item 1566), reforming the system of payment for water consumption, among other things. At present, the intake of ground and surface water as well as the discharge of wastewater into water or the ground, being water services within the meaning of the aforementioned Act, will be subject to a fee calculated according to new rules and rates.

A new entity established under the aforementioned Act, i.e. the State Water Farm Wody Polskie (Polish Waters), should provide an entity being a holder of a water permit with information determining the amount of the fee for water services already for the 1st quarter 2018 at the end of the quarter.
The provisions of the Act stipulating the rules for calculating the aforementioned fees are unclear and raise a number of interpretation doubts. It may result in unreasonable and excessive charging of fees for water services from entrepreneurs consuming water.

It should be kept in mind that every entity who finds its fee miscalculated, in particular if the way it is calculated is unclear or non-compliant with the valid regulations, may file a complaint with the authority determining the fee amount within 14 days of receipt of the information on its calculation.
